Welcome to the website (the “Site”) of Fourpost, Inc. (“Fourpost,” “we,” “us,” or “our”). Fourpost operates an online store and also retail stores that allow customers to experience fresh and innovative products in real life and to share information about the experience on Fourpost’s social media sites as well (collectively, including the Site, the “Services”).

At Fourpost we are committed to protecting your privacy and respect your rights regarding any personal information you may share with us.  This privacy policy (the “Privacy Policy”) is designed to provide transparency into our privacy practices and principles.  This Privacy Policy explains what Personal Information (defined below) we collect about you, how we use and share that data, and your choices concerning our data practices.

This Privacy Policy applies to personal information that you provided to us or was collected by us when you interacted with Fourpost through this Site, our products and services, or through our social media accounts (Facebook - @wearefourpost, Instagram - @wearefourpost, Twitter - @wearefourpost, LinkedIn - Fourpost, Pinterest - Fourpost, and Snapchat - @wearefourpost) and other Websites where this Privacy Policy is posted.  This Privacy Policy also explains the treatment of information provided or collected through software applications we make available on the Site or platforms in connection with your use of our Site or through your purchase of products from our retail stores.

By interacting with Fourpost through our retail stores, this Site, and our products, and services, you consent to our use of your Personal Information that is collected by us at our retail stores and Site, submitted by you, or collected automatically as described in this Privacy Policy. We may change or add to this Privacy Policy and we encourage you to review this Privacy Policy periodically.  Before submitting any Personal Information to Fourpost, and before accessing, using, or interacting with the Site and Services, you should carefully review the terms and conditions of this Privacy Policy and contact us if you have any questions.. Personal Information

1. PERSONAL INFORMATION WE COLLECT

“Personal Information” is information that identifies you personally, either alone or in combination with other information available to us. Examples of Personal Information include your name, contact details, information you provide when you create an account or a personal profile on our Site, information about the pages you have viewed and the paths you have taken through our Site, and your use of our Services.  Personal Information is also that information that is collected about you when you purchase products or use services in our retail stores. When we talk about “Personal Information” in this Privacy Policy, we are talking both about Customer Information, Order Information, Social Media Information and Device Information.

We collect information that alone, or in combination with other information in our possession, could be used to identify you. The “Personal Information” we collect is as follows:

        • “Customer Information” You Provide: When you make, or attempt to make, a purchase through the Site we collect certain information from you, including your name, address, email address, phone number and purchase history.  We refer to this Personal Information as “Customer Information.”.  In addition, we also collect Customer Information when you make a purchase at one of our retail locations or use a service available in one of our stores.  We also collect Personal Information when you contact us through the Site.  .
        • “Order Information”: We use the information you provide when you make a purchase from our Site or at one of our retail locations.  We refer to this Personal Information as “Order Information” and we use this information generally to process any purchases made at our retail stores or to fulfill any orders placed through the Site including processing your payment information, arranging for shipping, and providing you with invoices, purchase receipts, and/or order confirmations.   Fourpost does not retain your payment card information and this information is transferred directly to our payment processor Shopify, Inc. (“Shopify”) and is therefore subject to Shopify’s Terms of Service and Privacy Policy. Please read Shopify’s policies to learn more about how Shopify processes your Personal Information.

In addition, we use this Order Information to:

          • Communicate with you;
          • Screen our purchases and orders for potential risk or fraud; and
          • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Social Media Information: Fourpost has pages on social media sites such as Facebook, Instagram, Pinterest, Twitter, and LinkedIn (“Social Media Pages”). When you interact with our Social Media Pages, we collect Personal Information that you elect to provide to us, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with de-identified aggregate information and analytics regarding the use of our Social Media Pages.
  • Device Information: When you visit, use and interact with the Site, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit the Site, peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access the Service (e.g., Firefox, Microsoft Internet Explorer, etc.), broad geographical information, and navigation patterns. Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser. In particular, the following information is created and automatically logged in our systems:
  • Log data: Information that your browser automatically sends whenever you visit the Site (“log data”). Log data includes your Internet Protocol (IP) address, device identification, operating system, browser type and settings, the date and time of your request, and how you interacted with the Site and Services. Information collected may depend on the type of device you use and its settings.
  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

2. HOW WE USE PERSONAL INFORMATION

    We may use Personal Information for the above purposes as well as for the following purposes:

    • To provide the Site and Services;
    • To respond to your inquiries, comments, feedback or questions;
    • To send administrative information to you, for example, information regarding the Site and Services, and changes to our terms, conditions, and policies;
    • To analyze how you interact with our Site and Services;
    • To maintain and improve the content and functionality of the Site and Services;

In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics and purchasing trends with prospective business partners.     We may also use aggregated Personal Information collected when our customers visit our retail locations and purchase products, access services or simply enjoy the experiences offered at our retail locations.  This aggregated information is used to analyze the effectiveness of our retail and product marketing efforts to assist us in further improving the experience we offer our customers in our retail locations.  We will also use this information to develop a method for predicting future purchasing behaviors and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of customers to our retail locations and may share such aggregated information such as general customer statistics and purchasing trends with our prospective business partners.

    Marketing. We may use your Personal Information to contact you to tell you about products or services we believe may be of interest to you. For instance, if you elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out of receiving these emails by following the instructions contained in each promotional email we send you. You can also control the marketing emails and/or text messages you receive by updating your settings through your account. In addition, if at any time you do not wish to receive future marketing communications, you may contact us. If you unsubscribe from our marketing lists, you will no longer receive marketing communications, but we will continue to contact you regarding management of your account, other administrative matters, and to respond to your requests.

    3. SHARING AND DISCLOSURE OF PERSONAL INFORMATION

    When you visit our retail locations or access and use our Site, we collect, use, share, and otherwise process your Personal Information as described in this Privacy Policy. We will not share, sell, rent, or otherwise disclose your personal information to third parties without your consent, except in the limited circumstances described in this Privacy Policy.

    • Aggregated Non-Personal Data: We may disclose aggregated, non-personal data received from you through your visits to our retail locations, use our Site or Services and Purchase products or services at our retail locations or from our Site.  This aggregated information does not identify any individual, we may use this type of aggregated information without restriction. We may also share this demographic information with our business partners, but it will be aggregated and de-personalized, so that personal information is not revealed.
    • Vendors and Service Providers: To assist us in meeting business operations needs, and to perform certain services and functions, we may share Personal Information with vendors and service providers, including providers of hosting services, business intelligence tools, email newsletter services, payment processors, and web analytics services. Pursuant to our instructions, these parties will access, process or store Personal Information in the course of performing their duties to us.
    • Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.

We process Personal Information we obtain from you and our Customers as described herein on the legal basis of our legitimate interests in providing our retail locations and the products and experiences available at those locations, as well as the Site and Services to you. Such processing of your Personal Information is necessary for the purposes of the legitimate interests pursued by Fourpost or by our Service Providers related to our retail locations, our offer of products, experiences, and services as well as providing the Site.  Where appropriate, we may rely on alternate legal bases, such as your consent to certain types of processing of your Personal Information.

    Fourpost may transfer your Personal Information across national borders for the purposes described in this Privacy Policy.  Fourpost is a corporation established in and subject to the laws of the United States of America. Our web servers and databases are located in the United States, or in other countries, and the information on these servers and databases may be accessed by our staff (or our service providers’ staff) located in other countries when they have a “need to know”. Please be aware your Personal Information may be transferred to, and maintained on, computers located outside of your state or country of residence where the privacy laws may differ from, and may not be as protective as those, where you live. If you reside outside the United States and choose to allow us to collect information about you, please be aware that Fourpost may transfer your personal data to the United States and process and store it there.

    4. CALIFORNIA PRIVACY RIGHTS DISCLOSURES

    Under California Civil Code Section 1798.83 (known as the "Shine the Light" law), users of the Fourpost Site and Services, who are residents of California, may request certain information about our disclosure of personal information to third parties for their direct marketing purposes during the prior calendar year. To make such a request, please contact us at the address below or at privacy@fourpost.com and include as the subject line of the communication, and in the body of your message, "Request for California Privacy Information". We will comply with your request within thirty (30) days or as otherwise required by the statute. Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response.

    Please know that no matter where your Personal Information was collected, used, transferred or stored, if it was collected through our Site or Services, it will be processed in accordance with this Privacy Policy and any privacy notices or click-through agreements that apply to you.

    California Civil Code Section § 1798.83 permits users of our Site that are California residents to request the categories of Personal Information we disclosed to third parties for their direct marketing purposes in the year preceding the request, the names and addresses of such third parties, and, in certain circumstances, examples of the products or services marketed by such third parties.     5. CHILDREN

    Our Service is not directed at children who are under the age of 13. Fourpost does not knowingly collect Personal Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Information to Fourpost through the Service, please contact us and we will endeavor to delete such information from our databases.

    The Site and Service may contain links to other websites not operated or controlled by Fourpost, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third-Party Sites and not by this Privacy Policy.
